Minnesota Auto Accident Wrongful Death Claim
A wrongful death is when a death is caused by the wrongful act or omission of any person or corporation. An action to recover damages for a wrongful death is called a wrongful death claim. Minnesota wrongful death claims are governed by Minnesota Statutes, section 573.02 which allows for the spouse and heirs to make a claim for money damages.
In Minnesota wrongful death cases, a lawyer represents the court appointed trustee who is acting on behalf of the surviving spouse and heirs (which may include children, aunts, uncles, nieces nephews, etc.). The Minnesota wrongful death attorney will need to prove the following three elements in order to recover compensation:
- A human being died.
- The death was caused by the wrongful act or omission (negligence) of a person or corporation.
- The surviving spouse or next of kin suffered financial loss (damages) as a result of the Minnesota wrongful death.
Once the trustee and wrongful death lawyer collect the financial compensation, a plan for the distribution of funds to the heirs must be devised and approved by the court. In most cases, the heirs are able to reach an agreement and the judge simply approves it. But if the heirs cannot agree upon the distribution, the judge will take testimony and then decide the best allotment for each heir.
