GM Recalls 2011 Chevrolet Colorado and GMC Canyon Vehicles

General Motors recalled certain model year 2011 Chevrolet Colorado and GMC Canyon passenger vehicles equipped with a 2.9 or 3.7 liter engine and a 4-speed automatic transmission. These vehicles fail to conform to the requirements of Federal Motor Vehicle Safety Standard (FMVSS) No. 102, titled “Transmission Shift Lever Sequence, Starter Interlock and Transmission Braking Effect,” and FMVSS No. 114, titled “Theft Protection.”

The 6,768 vehicles affected by this recall may have been built with an automatic transmission adjustment clip that may not retain the shift cable in the correct position. If the shift cable is not in the correct position, the PRNDL shift lever may not accurately reflect the position of the transmission gear. The driver may mistakenly think that the car is in park and exit the vehicle. The vehicle could roll away striking a person around the vehicle or could result in a crash without prior warning.

The recall is set to begin on or about July 19, 2011. At that time, GM dealers will install a new automatic transmission adjustment clip at no cost. Go to safercar.gov for more information.

Wrong Way Driver Negligence

If there is sufficient evidence to prove that a wrong way driver involved in an accident was distracted, that will generally result in a finding of driver negligence. The four elements of driver negligence are:

  • Duty
  • Breach of Duty
  • Direct or Proximate Cause
  • Injury

Each of the above elements must be proved by a preponderance of the evidence. Pritzker Olsen auto accident attorneys have years of experience with Minnesota auto accident cases and a record of success. We know how to gather evidence and use it to build a winning case.

Recall on 2011 Chrysler, Dodge, Jeep Vehicles

On June 7, 2011, Chrysler issued a recall on certain 2011 models of Chrysler, Dodge and Jeep. The Chrysler recall potentially affects 11,351 units. The recall was issued because some of these vehicles may have been built with a missing or incorrectly installed steering column pivot rivet.

A missing or incorrectly installed pivot rivet could compromise the ability of the steering column to support the occupant loads in the event of a frontal crash. This could decrease the effectiveness of the frontal impact safety system, increasing the potential for injury in a frontal crash.

This recall includes the following 2011 models:

  • Chrysler 200
  • Chrysler 200 Convertible
  • Chrysler Town & Country
  • Dodge Avenger
  • Dodge Caliber
  • Dodge Grand Caravan
  • Dodge Journey
  • Dodge Nitro
  • Jeep Compass
  • Jeep Liberty
  • Jeep Patriot
  • Jeep Wrangler

The safety recall is expected to begin in June 2011. At that time, dealers will inspect for rivet presence and alignment and do needed repairs on the steering column pivot, free of charge. For more information on this Chrysler recall, visit safercar.gov.

Head On Collision Wrongful Death Compensation

When someone dies in a Minnesota head on collision due to the negligence of another, the family can recover monetary damages for the head-on collision wrongful death under Minnesota no-fault law and Minnesota’s wrongful death statute, Minnesota Statutes, Section 573.02. Under the MN wrongful death statute, damages are limited to financial loss resulting from the death. Damages may include:

  • Reasonable funeral expenses
  • Medical expenses
  • Loss of potential earnings
  • Loss of advice, assistance, comfort, counsel, protection and society

In Minnesota, damages for pain and suffering and emotional stress are not available in a car accident wrongful death case. However, with an experienced attorney, this will not prevent just compensation for the spouse and next of kin.

Head-On Collisions on Rural Two-Lane Highways

Many variables may contribute to rural highway dangers and head on collisions. As rural population and traffic increases, there are usually very few safety improvements made to rural highways to accommodate the additional flow of traffic (e.g., traffic lights, left turn lanes, right turn lanes). Other factors that may contribute to rural highway dangers and head on collisions include:

  • speeding
  • alcohol use
  • more teens and seniors on two-lane roads
  • complacent drivers (Drivers may feel safer closer to home and drive inattentively or without a seat belt.)
  • road rage (Impatient drivers may attempt to pass slow-moving traffic in an unsafe manner and cause a head on collision and death.)
  • blind intersections
  • growing congestion

Highway 14, between New Ulm and Rochester, may be the deadliest rural highway in Minnesota. Over the last 20 years, more than 125 people have died on Highway 14.¹ In 2008 the University of Minnesota launched a new interactive website where people can find and view the deadliest roads in Minnesota and the United States.

Highway 8, from Forest Lake to Taylors Falls is another death trap, especially in the Lindstrom area which has over-capacity traffic levels.² Although the number of accidents have dropped in recent years on Highway 8, due to the addition of traffic signals and dedicated right and left turn lanes, every year there several serious and/or fatal accidents.

Volvo 2012 S60 Recall

Volvo recalled approximately 450 S60s on June 3, 2011. The recall was on certain model year 2012 S60 passenger cars manufactured from January 18, 2011 through January 28, 2011. The male end of the fuel line quick connect was manufactured with dimensions out of specification, leading to excessive assembly force on the female connector assembly and the possibility that the locking function may not be engaged.

The 448 Volvo S60s affected by this recall may stall if the quick connector were to detach, increasing the risk of a crash. The customer may notice a fuel smell and leakage. A fuel leak in the presence of an ignition source could result in a fire.

The recall is expected to begin in June 2011. Volvo dealers will replace the fuel line at no charge to the consumer. More information on motor vehicle recalls is available on safercar.gov.

Cadillac 2011 SRX Recall

June 2, 2011: General Motors recalled certain model year 2011 Cadillac SRX passenger vehicles for failing to conform to the requirements of federal safety standards for occupant crash protection. These model vehicles are programmed to turn off the roof-rail airbag if the passenger sensing system determines that the right front passenger seat is unoccupied. If the roof-rail airbag is turned off, the right rear occupant may not be protected and suffer injuries in certain frontal and side crashes.

When the recall begins, on or about June 17, 2011, GM dealers will reprogram the sensing and diagnostic module at no charge. GM reported that more than 47,00 units are affected by this recall. For more information on this Cadillac recall and other motor vehicle recalls, visit safercar.gov.

Toyota Recalls 2001-2003 Prius Cars

On June 1, 2011, Toyota announced a voluntary recall on 2001-2003 Prius cars sold in the United States. The nuts securing the pinion shaft in the steering gear box assembly may become loose when the steering wheel is repeatedly and firmly turned to the full-lock position. If this were to occur, the vehicle could become more difficult to steer when making a left turn, increasing the risk of a crash.

This recall involves approximately 52,000 units in the U.S. , 106,000 units globally. The safety recall is scheduled to begin in early July 2011, at which time Toyota dealers will install improved nuts that secure the pinion shaft at no charge. Toyota estimates that the repairs will take about 4 hours.
